2. About Fuelteq and the FCR Technology
Fuelteq develops, markets and supplies the FCR, a patented pre-combustion fuel-conditioning device fitted directly to the fuel line of an engine. The device conditions fuel before it enters the combustion chamber, with the aim of enabling cleaner and more complete combustion. Fuelteq’s Products and Services are intended for use in road vehicles, industrial and agricultural machinery, and marine vessels.
Fuelteq’s published information on fuel savings, emission reductions, noise reduction and other performance figures is based on internal and third-party test results obtained under specific conditions. See Article 8 for important disclaimers regarding these figures.
3. Use of the Website
3.1 The Website is made available for the purpose of providing information about Fuelteq, the FCR technology, and for enabling visitors to request information or a quotation.
3.2 You agree to use the Website only for lawful purposes and to provide accurate and complete information when submitting any form on the Website, including the contact and newsletter sign-up forms.
3.3 Fuelteq takes reasonable care to keep the Website accurate and available, but does not warrant that the Website will be uninterrupted, error-free, or free of viruses or other harmful components, and accepts no liability for any loss or damage arising from your use of, or inability to use, the Website.
3.4 All content on the Website, including text, images, video, logos and the Fuelteq name and brand, is owned by or licensed to Fuelteq and is protected by intellectual property law. You may view and print Website content for personal, non-commercial reference only, and may not otherwise reproduce, distribute or exploit it without Fuelteq’s prior written consent.
3.5 The Website may contain links to third-party websites. Fuelteq is not responsible for the content or practices of any linked third-party website.
4. Enquiries and Quotations
4.1 Submitting the “Request more information” or contact form on the Website, or otherwise contacting Fuelteq, does not create a binding order or agreement. It is treated as a request for information, to which Fuelteq will respond, where appropriate, with a non-binding quotation.
4.2 Quotations issued by Fuelteq are valid for [30] days from the date of issue, unless stated otherwise, and are based on the information provided by the Customer at the time of the request.
5. Orders and Formation of the Agreement
5.1 An Agreement is formed when Fuelteq confirms acceptance of a Customer’s order in writing (including by email), or when Fuelteq commences delivery or installation of the Products and Services, whichever occurs first.
5.2 Fuelteq may decline any order, or make acceptance conditional (for example, on advance payment or a suitability assessment of the Customer’s engine or vessel), without being obliged to give reasons.
5.3 Any specifications, drawings, or technical information supplied by the Customer to enable Fuelteq to prepare a quotation or fulfil an order are assumed to be accurate; Fuelteq is not liable for consequences arising from incorrect or incomplete information supplied by the Customer.
6. Delivery and Installation
6.1 Delivery and installation dates communicated by Fuelteq are estimates and are not binding deadlines, unless expressly agreed otherwise in writing.
6.2 Installation of the FCR may be carried out by Fuelteq or by an authorised installation partner. The Customer is responsible for providing timely and safe access to the relevant vehicle, machine or vessel, and for any information reasonably required for installation.
6.3 Risk in the FCR passes to the Customer upon delivery or, where Fuelteq carries out the installation, upon completion of installation.
7. Retention of Title
Ownership of any FCR supplied by Fuelteq remains with Fuelteq until the Customer has paid all amounts owed to Fuelteq in respect of that device in full. Until that time, the Customer must not sell, pledge, remove, or otherwise encumber or dispose of the device without Fuelteq’s prior written consent, other than in the ordinary use for which it was installed.
8. Product Performance, Test Results and Disclaimers
8.1 Figures published by Fuelteq or referenced in its materials — including indicative fuel savings (in the order of 10% or more), engine noise reduction (up to approximately 30%), extended oil-change intervals, and reductions in emissions such as CO2, NOx and particulate matter — are derived from internal testing and independent test institutes under specific operating conditions.
8.2 Actual results depend on factors outside Fuelteq’s control, including engine type, size and age, fuel quality, operating and driving style, maintenance history, and vessel or vehicle usage patterns. Accordingly, published figures are indicative only and do not constitute a guarantee of the results any individual Customer will achieve. Measurable effects typically become apparent approximately two to three weeks after installation.
8.3 Nothing on the Website or in Fuelteq’s marketing materials should be relied upon as a guarantee of specific fuel, cost or emissions savings for a particular vehicle, machine or vessel. Customers seeking assurance on expected performance for their specific application should request a tailored assessment from Fuelteq before ordering.
9. Warranty
9.1 Fuelteq warrants that the FCR supplied will be free from material defects in materials and workmanship for a period of 36 months from the date of installation, unless a different period is agreed in writing.
9.2 This warranty does not cover defects or damage caused by misuse, incorrect installation by a party other than Fuelteq or its authorised partner, unauthorised modification or repair, normal wear and tear, or failure to operate the device in accordance with Fuelteq’s instructions.
9.3 Warranty claims must be submitted to Fuelteq at info@fuelteq.eu, describing the defect. Fuelteq’s sole obligation under this warranty, at its discretion, is to repair or replace the defective device.
10. Intellectual Property
10.1 The FCR technology is protected by patent and by other intellectual property rights owned or controlled by Fuelteq and its research and development partners. All such rights, together with the Fuelteq name, logo and any certification marks displayed on the Website (including DEKRA certification), remain the property of Fuelteq or the relevant rights holder.
10.2 Purchase of an FCR grants the Customer the right to use that specific device for its intended purpose only. No licence is granted to reproduce, reverse-engineer, decompile, disassemble, or otherwise attempt to derive the underlying technology, design or composition of the FCR.
11. Limitation of Liability
11.1 To the extent permitted by law, Fuelteq’s total liability arising out of or in connection with an Agreement, whether in contract, tort or otherwise, is limited to the amount paid by the Customer for the Products and Services giving rise to the claim in the twelve (12) months preceding the event giving rise to liability.
11.2 To the extent permitted by law, Fuelteq is not liable for indirect or consequential loss, including loss of profit, loss of revenue, loss of use, loss of contracts, or business interruption, even if Fuelteq was advised of the possibility of such loss.
11.3 Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable mandatory law, including liability for death or personal injury caused by negligence, liability for intent or gross negligence, or liability under applicable product liability legislation.
12. Force Majeure
Fuelteq is not liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond its reasonable control, including but not limited to supplier delays, transport disruption, raw material shortages, industrial action, or governmental measures. If a force majeure event continues for more than 60 days, either party may terminate the affected order by written notice.
13. Confidentiality
Each party will treat as confidential any technical, commercial or operational information disclosed by the other party in connection with an Agreement that is marked as confidential or would reasonably be understood to be confidential, and will not disclose such information to third parties except as required to perform the Agreement or by law.
14. Privacy
Fuelteq processes personal data submitted via the Website (for example, through the contact and newsletter forms) in accordance with its Privacy Policy, which forms part of these Terms.
15. Amendments
Fuelteq may update these Terms from time to time, for example to reflect changes in its Products and Services or in applicable law. The version published on the Website at the time of your use or order applies. Changes to Terms already forming part of a signed Agreement require the written agreement of both parties.
16. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force, and the invalid provision will be replaced by a valid provision that most closely reflects its original intent.
17. Governing Law and Disputes
17.1 These Terms and any Agreement between Fuelteq and a Customer are governed by the laws of the Netherlands, excluding its conflict-of-law rules and excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
17.2 Any dispute arising out of or in connection with these Terms or an Agreement will be submitted to the competent court in the Netherlands, without prejudice to any mandatory consumer-protection rules that entitle a Customer acting as a consumer to bring proceedings before the court of their own place of residence.
